NAPBS Comments on Austin's Proposed 'Ban the Box' Ordinance

NAPBS submitted comments in response to proposed ban the box ordinance in Austin, Texas. The comments pertained to the requirement to notify an applicant in writing if the adverse action decision is based on the criminal history.

NAPBS stated that for employers that conduct background screening via Consumer Reporting Agencies (CRAs), the Fair Credit Reporting Act (FCRA) requires a specific adverse action process to be followed any time an employer is potentially making an adverse decision. NAPBS also recommended modifications to the legislation.

The proposed ban the box ordinance is on the agenda for discussion at the March 24, 2016, Austin City Council Meeting.
