FTC Issues Final Follow Up Study on Credit Report Accuracy

The Federal Trade Commission (FTC) issued a follow-up study on credit report accuracy that found most consumers who previously reported unresolved errors on their credit reports believe that some previously disputed information is still on their report. According to the press release, the congressionally mandated study is the sixth and final study on national credit report accuracy by the FTC. It follows up on a study issued by the FTC in 2012, which examined how many consumers had errors on one of their three major credit reports.

UPDATE: Walt Disney Background Check Lawsuit Deemed Credible by Judge

According to Law360, a California Judge has ruled the background check class action lawsuit against Disney is viable and has enough evidence to continue forward. The plaintiff in the case provided “enough sufficient questions of fact” to keep the case alive. Law360 reports Judge Jane L. Johnson found Disney did not provide enough evidence to prove they followed the Fair Credit Reporting Act’s (FCRA) adverse action laws. Specifically, Disney could not, without a doubt, prove they sent the plaintiff a copy of the background check and give him a chance to dispute the information before making a hiring decision.

Paramount Faces Lawsuit Over Alleged Illegal Background Checks

Paramount Pictures Corporation, the large film studio and television production company, is facing a class action lawsuit for allegedly obtaining employment background checks on applicants illegally. Plaintiff Michael Peikoff filed the suit claiming Paramount violated the FCRA by not providing and obtaining a clear consent of disclosure for a background check.

EEOC, Mach Mining Battle it Out in Supreme Court

The Supreme Court heard oral arguments Tuesday in a case about the Equal Employment Opportunity Commission’s (EEOC) handling of discrimination complaints and whether a court may enforce the EEOC’s duty to conciliate discrimination claims before filing suit. The case involves Mach Mining LLC, an Illinois mining company the EEOC accused of failing to hire women and provide facilities for them at a coal mine it opened in 2006.

Chicago Ban the Box Law Includes Smaller Employers, City Agencies

The City of Chicago has expanded the coverage of Illinois’ Ban the Box law to include private employers that are licensed in the city and/or maintain a business facility within city limits and have fewer than 15 employees. Multiple city agencies will also be required to Ban the Box, including the City of Chicago, Chicago Public Schools, Chicago Park District, Chicago Transit Authority, City Colleges of Chicago, the Chicago Housing Authority, and the Public Building Commission of Chicago.

The Securities and Exchange Commission (SEC) approved a Financial Industry Regulatory Authority (FINRA) rule that mandates firms strengthen the background investigation of applicants seeking registration. FINRA’s new rule requires member firms to “establish and implement written procedures reasonably designed to verify accuracy and completeness of the information contained in an applicant’s Form U4 no later than 30 calendar days after the form is filed with FINRA.”

Hospital’s Botched Background Check to Blame in Alleged Patient Rape

A female hospital patient who claims she was raped by a male nurse says it's the hospital's fault for failing to perform an adequate background check when it hired the nurse with a questionable past. Debe Castro was admitted at the Medical Center of Plano in the Dallas-Fort worth metroplex in January 2013 where she was preparing for a heart procedure when the incident occurred. Reports say Castro was sedated — but alert — when Wilson Karago, her nurse, allegedly raped her.

An audit by the Colorado Human Services Department found foster relatives were not being properly background checked. Four children found to be placed with registered sex offenders initiated the investigation.

An audit by the Colorado Human Services Department found foster relatives were not being properly background checked. Four children found to be placed with registered sex offenders initiated the investigation. According to KMGH-TV, a review of 46 of Colorado’s 65 counties found only 65 percent of the required screenings were completed. By law, four different records must be searched: 1) the Colorado Bureau of Investigation criminal history check 2) Fingerprint Check 3) FBI criminal history check 4) State child welfare database (TRAILS) check for child abuse and/or neglect.
